TKO Booking Agency, Andrew Goodfriend and the Josh Todd Dispute

TKO Booking Agency, also known as The Kirby Organization, is a music booking agency founded by the late Dave Kirby. This page covers only the agency's appearance in the documented record of the Josh Todd and Todd Meagher dispute, where it was named as a defendant and where Andrew Goodfriend is identified in the record as a partner in the agency. It is not a company profile, is not affiliated with the agency, and makes no statement about its present-day roster, staff or business.

Scope and limits

Claims made in civil pleadings are identified as allegations and were not proven by the fact of being filed. Determinations by the California Labor Commissioner are identified as findings. Todd Meagher's recollections are identified as his firsthand account. No confidential settlement term is described anywhere on this site.

Todd Entertainment used licensed booking representation

Todd Entertainment LLC, the Nevada company formed on February 4, 2003 and owned 50/50 by Josh Todd and Todd Meagher, financed the recording and touring operation behind Todd's solo album You Made Me. It did not procure its own live engagements. Live bookings were handled by Andrew Goodfriend's documented booking role as a licensed booking agent, who was paid commission on the engagements he handled.

That distinction matters to the case. The investor supplied capital and administration; licensed procurement of employment sat with the agent. The later Talent Agencies Act petition nonetheless targeted the investor.

Named in pleadings

TKO Booking Agency as a defendant in the litigation

The civil litigation that followed extended well beyond Todd and Meagher. TKO Booking Agency was named as a defendant, and Andrew Goodfriend is identified in the record as a partner in the agency. The Agency Group also appears in the record in connection with Goodfriend. The claims concerned fraud, breach of fiduciary duty, double-charging of commissions and the agency's role in the conduct later raised under California's Talent Agencies Act.

Those are allegations pleaded by one side. They are not findings of liability, and this page does not present them as proven. Where the record does not establish which agency held which engagement or in what period, this site does not fill the gap.

Rock Odyssey, Osaka Dome, July 2004

The engagement most closely examined in the dispute is the Rock Odyssey festival of July 24–25, 2004 at Osaka Dome in Nishi-ku, Osaka. Goodfriend told Meagher he had no Japan contacts and instructed him to approach the project's Japanese distribution partner. Udo Artists made an offer, Meagher forwarded it to Goodfriend, and Goodfriend handled the booking and took his commission. See the Rock Odyssey Japan booking history.

Buckcherry-related activity in the record

After ceasing to act for Todd Entertainment, Goodfriend went on to work as a booking agent for Buckcherry, the band Josh Todd returned to. The Buckcherry 2003–2005 transition page sets out that continuity alongside the personnel side. This site does not assert which agency, if any, held Buckcherry's booking representation at any given time, and does not assert any current relationship between TKO Booking Agency, Andrew Goodfriend or Buckcherry.

Public proceeding

The Talent Agencies Act dispute

Josh Todd's petition was heard by the California Labor Commissioner as TAC No. 13418. Background on the statute is on the Talent Agencies Act proceeding page, and the outcome is on the Labor Commissioner determination page. Sworn testimony from the booking side is held on the separate Andrew Goodfriend deposition page.
